The Ex Parte Commissioner’s Office is in Room 107, immediately to the right of the Clerk’s Office, and is available to hear ex parte matters Monday through Friday from 9 to 11 AM and from 1:30 to 3:30 PM.

Noticed Hearings:

  • If for a Guardianship Report & Account: Before the judge assigned to the case.
    • Requires matter to be set for hearing by filing Note of Issue.
  • For all others: 1:30 – 4 PM daily.
    • Requires matter to be set for hearing by filing Note for Commissioner’s Calendar at least 6 Court days before the desired hearing date.
    • No confirmation of hearing is required (unlike Snohomish County).
    • Cancellation of hearing requires phonecall to Commissioner’s Office: 253 798-6697.
    • Working papers are due by noon, 2 Court days before the hearing date.

Caution: Unlike the Clerk’s Offices in, for example, King or Snohomish Counties, the Pierce County Clerk’s Office will not set a hearing by the filing of a generic Notice of Hearing.  For a hearing to be set in Pierce County, a specific Pierce County form is required to be filed, for example, a Pierce County Note for Commissioner’s Calendar.

Opening a probate file at the Clerk’s Office requires a completed Pierce County Case Type 4 Cover Sheet.

The Clerk’s Office supplies Letters, so you don’t have to prepare a Letters form.

Petition for Probate and the Will has already been filed as a Will-Only, you shouldn’t have to go to the Clerk’s Office to get the Will before going to Court, as the Will should have already been scanned and be available to the Judge on his/her computer.
